By accessing, downloading, installing, or using Benjamin-ASR and/or the website benasr.com (collectively, the “Service”), you (“you”, “your”, or “User”) agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree with any part of the Terms, you must immediately discontinue all use of the Service.

2. Beta Software Notice

The Service is currently offered as a beta release. Features may change, break, or be removed without notice. The Service may contain bugs or errors and is provided "as is" for testing and feedback purposes only. You understand and accept that performance or availability may be unpredictable.

3. No Warranties

To the maximum extent permitted by applicable law, Benjamin-ASR provides the Service without any warranties or representations of any kind, whether express, implied, statutory, or otherwise. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, non‑infringement, accuracy, reliability, or availability.

4. Limitation of Liability

To the fullest extent permitted by law, Benjamin-ASR and its directors, officers, employees, agents, partners, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including loss of profits, data, goodwill, or other intangible losses) arising out of or in connection with your use of—or inability to use—the Service, even if advised of the possibility of such damages. In no event shall our aggregate liability exceed EUR 100 or the amount you actually paid (if any) for the Service in the twelve (12) months preceding the event giving rise to the claim, whichever is lower.

5. User‑Submitted Content & Data

  1. Voluntary Submission – The Service includes optional forms and feedback mechanisms (the “Forms”). You agree to indemnify, defend, and hold harmless Benjamin-ASR from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service or violation of these Terms.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict‑of‑laws rules. Any dispute arising under these Terms shall be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.

11. Changes to Terms

We may update these Terms at any time. Material changes will be announced on the Website or via the Service. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
